A formation service sells convenience. Your LLC still comes from a state filing, your EIN still comes from the IRS, and every bank or payment provider makes its own decision about you.

Read the order line by line. Identify the state filing, the provider’s work, and any separate service that continues after formation. Assign each promised result to the office or company that controls it.

This guide is the purchasing layer. The main formation guide covers the full sequence, while the requirements wizard tells you which steps apply to your facts.

Start with the state filing

The state filing is the one unavoidable transaction in the package. The state sets the filing requirement and the official fee. Ask the provider which preparation and submission work its order covers. Any provider charge is separate from the official state charge.

Keep those amounts separate, even when checkout combines them. Read the relevant state entry in the True Cost Worksheet for its modeled charges, source confidence and exclusions. Ask whether the order needs additional filing steps or charges that fall outside that estimate.

Before comparing packages, open the True Cost Worksheet and record the state costs, verification dates and exclusions. Compare those with the provider’s itemized quote. Ask which extra charges could apply to your order.

Paid filing help is a choice. California’s Secretary of State expressly says businesses do not have to use another company to submit their documents. If you prefer to file yourself, check your chosen state’s instructions, submission method and agent requirements before starting.

Decide which work you are buying

Ask whether the formation order covers preparing the document, submitting it to the state, correcting a rejection and delivering the accepted record. Record the promised completion point for each task.

Review registered-agent coverage, EIN assistance, document storage, reminders, mail handling and tax preparation separately. For each item, ask who performs the work, what you receive, and whether it renews. A reminder does not establish that a filing has been submitted.

The IRS issues EINs without a fee. A provider can charge for application assistance, so identify that service charge separately. Confirm that its process supports your responsible party’s tax-ID status and the company’s actual business location. Use the EIN guide to check the application route.

Test the service against the non-US path

Many formation flows are written around a US owner with a Social Security number. Your first screening question is therefore simple: does the provider expressly handle an EIN application for a foreign responsible party with no SSN or ITIN?

The IRS Form SS-4 instructions provide routes for that applicant. The online assistant has conditions that commonly close it to a non-US founder, while the Form SS-4 instructions explain how to complete the responsible-party line when that person has no SSN or ITIN and is ineligible to obtain one. The exact procedure belongs in the EIN guide. Your purchasing question is whether the service knows and supports that procedure, not whether its package merely contains the letters EIN.

An ITIN is not automatically required to own the LLC or obtain its EIN. IRS guidance ties an ITIN to a federal tax purpose. Treat a package that presents an ITIN as a universal formation prerequisite as a prompt for further questions.

Keep the three addresses separate

Keep a clean record of which address serves which function.

The registered-agent address is the physical in-state location for legal process and official communications. It is a continuing statutory role. The registered-agent guide explains that role and the consequences of letting it lapse.

Your principal business address is where you actually run the company. Providers like Mercury publish eligibility policies rejecting a registered-agent address as a substitute for that operating address, covered in the non-resident banking guide. A formation service can supply an agent. It cannot turn that agent’s office into your place of business.

Mail forwarding is a third service again. If a package includes it, confirm which mail it accepts, how it reaches you, and whether the address is suitable for the particular form you intend to complete.

Read the renewal before the introduction

Registered-agent coverage is continuous, so its renewal matters more than its introductory presentation. If the first year is discounted or bundled, locate the standard renewal terms before you compare it with another offer.

Record the renewal date, renewal amount, cancellation method, notice period, and what happens to documents if you leave. If any of those terms are missing, treat the omission as a finding. Do not fill the blank with an assumption.

The same discipline applies to compliance subscriptions, mail services, and tax plans. Mark every recurring item, then place it beside the state obligations in the annual compliance calendar. A low formation charge can be perfectly legitimate. It is simply not a useful measure of the continuing relationship.

Remove add-ons that solve no current obligation

Start with the legal requirement, then decide whether you want help satisfying it. Do not reverse that order.

The clearest current example is beneficial ownership reporting. The federal final rule published in August 2026 limits the reporting-company definition to qualifying foreign-formed entities registered in the United States. A US-formed LLC is exempt, including one owned by a foreign person. A domestic BOI filing add-on therefore solves no current filing obligation for the company described in this guide.

Apply the same test elsewhere. Check the EIN requirements for your filing and intended providers. An ITIN is not automatically part of obtaining an EIN. A registered agent is mandatory, but general mail handling is a separate choice. Compliance reminders may help, but responsibility for the filing remains with the company.

Audit evidence, not badges

A headline rating is not enough to evaluate a service. Check how many independent reviews sit behind it, how recent they are, what the negative reviews describe, and whether the company answers failures in public. Merchant-controlled testimonials tell you less about cancellations, missed filings, and support breakdowns than an independent record containing both praise and complaints.

Then read the provider’s own terms. Look specifically for renewal language, cancellation steps, refund boundaries, and a written statement about support for foreign owners. If a material promise appears only in a blog post or sales conversation, ask for it in the order terms or in writing.

You are selecting a service for the quality of the handoff and the clarity of everything that follows.

Complete a buyer worksheet before paying

Save the quote and the terms that apply to your order. Fill in these fields before checkout:

Item Record before paying
Formation filing State, document, official charges, provider charge and submission method.
Extra work Separate prices for requested copies, expedited handling, mail forwarding or other additions. Mark optional items.
EIN assistance Application route, responsible-party requirements, provider charge and document you will receive.
Registered agent Coverage start and end, included work, renewal amount and payment date.
Year-two bill Each recurring service, renewal amount, auto-renewal setting and notice period.
Cancellation How to cancel each service, required notice and how to arrange a replacement agent if needed.
Refunds What the terms say before submission, after submission, after rejection and after acceptance. Separate provider charges from state charges.
Documents Accepted formation record, any ordered copies, EIN confirmation if ordered, delivery method and download access after cancellation.
Ongoing filings Which filings the provider submits, which it only reminds you about, and which remain yours to arrange.

Do not assume a rejected application is automatically refunded or that cancellation covers every subscription. Obtain any missing answer in writing before paying.

Keep the completed worksheet with your order confirmation. Add renewal dates and filing responsibilities to the printable formation checklist. Use the requirements wizard to organize the sequence and the True Cost Worksheet for the state-cost comparison.
